Federal Tort Claims Act (FTCA) Health Center Policy Manual

Policy Information Notice 2011-01

The Federal Tort Claims Act (FTCA) Health Center Policy Manual is the primary source for information on the FTCA for the Health Center Program grantees and related stakeholders.  The FTCA manual will be amended, as needed, to incorporate future FTCA policy change and clarifications.  While this FTCA Policy Manual is intended to be the principal Health Center program resource on FTCA matters, please note that if there are any conflicts between its content and FTCA law as interpreted by the courts (including federal statutes, regulations, and case law), the law prevails.

The FTCA Policy Manual is divided into three sections—Section I: Eligibility and Coverage; Section II: Claims and Lawsuits; and Section III: Appendix.  HRSA consolidated the following FTCA Policy Information Notices (PINs) and Program Assistance Letters (PALs) and incorporated the materials into the three sections of the FTCA Policy Manual: 

  • PIN 1995-29: Update of the Policies and Procedures for Federal Tort Claims Act Coverage for Section 329, 330, 340, 340A Deemed Centers
  • PIN 1996-07: Policies and Procedures for the Implementation of the Federally Supported Health Centers Assistance Acts
  • PIN 1997-06: Clarification of Certain Policies and Procedures for Health Centers Deemed Covered under the Federal Tort Claims Act for Medical/Dental Malpractice Liability
  • PIN 1999-08: Health Centers and the FTCA
  • PAL 1999-15: Questions and Answers on the Federal Tort Claims Act Coverage for Section 330 Deemed Grantees  
  • PIN 2001-11: Clarification of Policy for Health Centers Deemed Covered Under the FTCA for Medical Malpractice
  • PIN 2001-19: Procedures for Handling Subpoenas and Other Requests for Testimony of Health Center Employees in Private Litigation
  • PIN 2002-23: New Requirements for Deeming under the Federally Supported Health Centers Assistance Act
  • PAL 2005-01: Federal Tort Claims Act Policy Clarification on Coverage of Corporations Under Contract with Health Centers
  • PIN 2007-16: FTCA Coverage for Health Center Program Grantees Responding to Emergencies

Accordingly, any references to the listed issuances that are found in other HRSA publications or guidances should be deemed as referring to the FTCA Policy Manual.
